식품위생법 제31조(자가품질검사 의무)

① 식품등을 제조ㆍ가공하는 영업자는 총리령으로 정하는 바에 따라 제조ㆍ가공하는 식품등이 제7조 또는 제9조에 따른 기준과 규격에 맞는지를 검사하여야 한다. <개정 2010.1.18, 2013.3.23>

② 식품등을 제조ㆍ가공하는 영업자는 제1항에 따른 검사를 「식품ㆍ의약품분야 시험ㆍ검사 등에 관한 법률」 제6조제3항제2호에 따른 자가품질위탁 시험ㆍ검사기관에 위탁하여 실시할 수 있다. <개정 2013.3.23, 2013.7.30, 2018.12.11>

③ 제1항에 따른 검사를 직접 행하는 영업자는 제1항에 따른 검사 결과 해당 식품등이 제4조부터 제6조까지, 제7조제4항, 제8조, 제9조제4항 또는 제9조의3을 위반하여 국민 건강에 위해가 발생하거나 발생할 우려가 있는 경우에는 지체 없이 식품의약품안전처장에게 보고하여야 한다. <신설 2011.6.7, 2013.3.23, 2013.7.30, 2022.6.10>
