수산업법 제77조(어구 수거 해역 및 수거 기간 지정 등)

① 행정관청은 수산자원의 보호와 해양오염 방지를 위하여 필요하다고 인정하면 제95조에 따른 해당 수산조정위원회의 심의를 거쳐 어구 수거 해역 및 수거 기간을 정할 수 있다.

② 행정관청은 제1항에 따라 어구 수거 해역 및 기간을 정한 경우에는 제15조, 제40조, 제43조 및 제46조에 따라 어업허가를 받은 자에게 해양수산부령으로 정하는 바에 따라 그 사실을 알려야 한다.

③ 행정관청은 제1항에 따라 어구 수거 해역 및 수거 기간을 정한 경우 그 대상 해역에서 어업허가를 받은 자에게 수면에 설치한 어구를 수거하도록 명하거나 제50조에서 준용되는 제33조제1항제1호에 따라 어업을 제한할 수 있다.

④ 제1항에 따른 어구 수거 기간은 1개월을 초과할 수 없다. 다만, 해역 여건 또는 천재지변 등으로 기간의 연장이 필요한 경우 15일 이내의 범위에서 한 차례만 그 기간을 연장할 수 있다.

⑤ 행정관청은 제3항에 따른 어구 수거 기간 동안 수거되지 아니한 어구를 제78조제1항에 따라 수거하여 처리할 수 있다.

⑥ 제1항부터 제5항까지에서 규정한 사항 외에 어업 제한 절차, 어구 수거 명령 및 기간 등에 필요한 사항은 대통령령으로 정한다.
