소비자기본법 제70조(단체소송의 대상등)

Framework Act on Consumers, Article 70 (Subject of Organizational Lawsuits)

다음 각 호의 어느 하나에 해당하는 단체는 사업자가 제20조의 규정을 위반하여 소비자의 생명ㆍ신체 또는 재산에 대한 권익을 직접적으로 침해하고 그 침해가 계속되는 경우 법원에 소비자권익침해행위의 금지ㆍ중지를 구하는 소송(이하 "단체소송"이라 한다)을 제기할 수 있다. <개정 2016.3.29>

1. 제29조의 규정에 따라 공정거래위원회에 등록한 소비자단체로서 다음 각 목의 요건을 모두 갖춘 단체

가. 정관에 따라 상시적으로 소비자의 권익증진을 주된 목적으로 하는 단체일 것

(a)어 Under언더 its잇츠 articles아터클즈 of어^v브 incorporation,인코퍼^r레이션 it잇 is이즈 an앤 organization오거너제이션 whose후즈 main메인 purpose퍼퍼스 at앳 all올 times타임즈 is이즈 promoting프^r러모우팅 consumer컨수머 rights^r라잇츠 and앤드 interests;인트^r러스츠

나. 단체의 정회원수가 1천명 이상일 것

다. 제29조의 규정에 따른 등록 후 3년이 경과하였을 것

3. 「상공회의소법」에 따른 대한상공회의소, 「중소기업협동조합법」에 따른 중소기업협동조합중앙회 및 전국 단위의 경제단체로서 대통령령이 정하는 단체

4. 「비영리민간단체 지원법」 제2조의 규정에 따른 비영리민간단체로서 다음 각 목의 요건을 모두 갖춘 단체

가. 법률상 또는 사실상 동일한 침해를 입은 50인 이상의 소비자로부터 단체소송의 제기를 요청받을 것

나. 정관에 소비자의 권익증진을 단체의 목적으로 명시한 후 최근 3년 이상 이를 위한 활동실적이 있을 것
