산지관리법 제47조(타인 토지 출입 등)

① 산림청장등은 소속 공무원으로 하여금 기본계획 및 지역계획의 수립을 위한 산지기본조사, 산지지역조사, 보전산지의 지정ㆍ변경 또는 지정해제, 산지전용ㆍ일시사용제한지역의 지정ㆍ해제 등 산지의 보전ㆍ이용 등에 관한 사항을 조사하게 하기 위하여 필요한 경우에는 타인의 토지에 출입하게 하거나 그 토지를 일시 사용하게 할 수 있으며, 부득이한 경우에는 입목ㆍ대나무 또는 그 밖의 장애물을 제거하거나 변경하게 할 수 있다. <개정 2012.2.22, 2020.2.18>

② 제1항에 따라 타인의 토지에 출입하려는 사람과 타인의 토지를 일시 사용하거나 장애물을 제거하거나 변경하려는 사람은 그 출입ㆍ사용 또는 제거하거나 변경하려는 날의 3일 전까지 그 토지의 소유자ㆍ점유자 또는 관리인에게 그 일시와 장소를 알려야 한다.

③ 일출 전이나 일몰 후에는 해당 토지 점유자의 승낙 없이는 택지나 담 또는 울타리로 둘러싸인 타인의 토지에 출입할 수 없다.

④ 제1항에 따라 조사를 하는 사람은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여주어야 한다.
