산지관리법 제46조의3(현장관리업무담당자의 지정 및 교육)

① 다음 각 호의 어느 하나에 해당하는 자는 토석채취사업장의 안전 확보 및 산림피해 방지 등의 업무를 담당하는 사람(이하 "현장관리업무담당자"라 한다)을 지정하여야 하고, 이를 산림청장등에게 신고하여야 한다. 현장관리업무담당자를 변경하는 경우에도 또한 같다.

② 현장관리업무담당자는 둘 이상의 토석채취사업장의 업무를 겸할 수 없다. 다만, 동일한 사업자가 연접하여 토석채취허가를 받는 등 대통령령으로 정하는 경우에는 그러하지 아니하다. <신설 2017.4.18>

③ 현장관리업무담당자는 대통령령으로 정하는 기관에서 토석채취사업장의 안전 확보 및 산림피해 방지 등의 업무 수행에 필요한 교육을 받아야 한다. 다만, 산림청장은 「광업법」 제42조제1항에 따른 채굴계획의 인가를 받은 자가 제27조제2항에 따라 매매계약을 체결하거나 토석채취허가를 받은 경우로서 「광산안전법」 제7조에 따라 교육을 이수한 경우 등 대통령령으로 정하는 경우에는 본문에 따른 교육의 전부 또는 일부를 면제할 수 있다. <개정 2017.4.18, 2020.5.26>

④ 제1항에 따른 현장관리업무담당자의 업무 지정기준, 지정 및 변경 신고기한, 신고방법 등과 제3항에 따른 교육의 기간ㆍ내용ㆍ비용 및 그 밖에 교육에 필요한 사항은 대통령령으로 정한다. <개정 2017.4.18>
