빈집 및 소규모주택 정비에 관한 특례법 제12조(사업시행계획인가)

① 사업시행자(사업시행자가 시장ㆍ군수등인 경우는 제외한다. 이하 이 조에서 같다)는 제9조제2호 또는 제4호의 방법으로 빈집정비사업을 시행하는 경우 제13조에 따른 사업시행계획서를 작성하여 시장ㆍ군수등에게 제출하고 사업시행계획인가를 받아야 한다. 인가받은 사항을 변경하는 경우에도 또한 같다. 다만, 대통령령으로 정하는 경미한 사항을 변경하는 경우에는 시장ㆍ군수등에게 신고하여야 한다.

② 시장ㆍ군수등은 특별한 사유가 없으면 제1항에 따른 사업시행계획서(사업시행계획서의 변경을 포함한다)가 제출된 날부터 60일 이내에 인가 여부를 결정하여 사업시행자에게 통보하여야 한다.

③ 시장ㆍ군수등은 제1항에 따른 사업시행계획인가(시장ㆍ군수등이 직접 사업시행계획서를 작성한 경우를 포함한다)를 하거나 변경인가(시장ㆍ군수등이 직접 작성한 사업시행계획서를 변경한 경우를 포함한다)를 하는 경우에는 국토교통부령으로 정하는 방법 및 절차에 따라 그 내용을 해당 지방자치단체의 공보에 고시하여야 한다. 다만, 제1항 단서에 따라 경미한 사항을 변경하는 경우에는 그러하지 아니하다.
