방문판매 등에 관한 법률 제26조(다단계판매업자의 휴업기간 중 업무처리 등)

① 다단계판매업자는 그 휴업기간 또는 영업정지기간 중에도 제17조제1항에 따라 준용되는 제8조제1항 및 제3항에 따른 청약철회등의 업무와 제18조제1항부터 제8항까지의 규정에 따른 청약철회등에 따른 업무를 계속하여야 한다.

② 다단계판매원은 다단계판매업자가 폐업하거나 그 등록이 취소된 경우 그 폐업 또는 등록취소 당시 판매하지 못한 재화등을 다른 사람에게 판매한 때에는 그 다단계판매원이 청약철회등에 따라 반환되는 재화등을 반환받고, 재화등을 반환받은 날부터 3영업일 이내에 재화등의 대금을 환급하여야 한다.

③ 제13조제1항에 따라 공정거래위원회에 등록하거나 시ㆍ도지사에게 등록한 다단계판매업자가 파산선고를 받거나 관할 세무서에 폐업신고를 한 경우 또는 6개월을 초과하여 영업을 하지 아니하는 등 실질적으로 영업을 할 수 없다고 판단되는 경우에는 등록을 받은 행정기관의 장은 그 등록을 직권으로 말소할 수 있다.
