Act on Urban Parks and Green Areas, etc., Article 25 (Restoration to Original State)

① 제24조에 따라 도시공원의 점용허가를 받은 자는 그 점용기간이 끝나거나 점용을 폐지하였을 때에는 지체 없이 도시공원을 원상으로 회복하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 그러하지 아니하다.

1. 도시공원의 경관을 저해하거나 도시공원의 이용 또는 조성에 장애가 되는 등 원상으로 회복하는 것이 부적당하여 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ특별자치도지사ㆍ시장 또는 군수의 승인을 받은 경우

1. ② 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ특별자치도지사ㆍ시장 또는 군수는 다음 각 호의 어느 하나에 해당하는 자에게는 지체 없이 원상회복을 명할 수 있다.

1. 제1항에 따른 원상회복을 하지 아니한 자

2. 점용허가를 받지 아니하고 제24조제1항 각 호의 어느 하나에 해당하는 행위를 한 자

③ 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ특별자치도지사ㆍ시장 또는 군수는 제2항에 따른 원상회복의 명령을 받은 자가 원상회복을 하지 아니하면 「행정대집행법」에 따른 행정대집행에 의하여 원상회복을 할 수 있다.
