국민기초생활 보장법 제46조(비용의 징수)

① 수급자에게 부양능력을 가진 부양의무자가 있음이 확인된 경우에는 보장비용을 지급한 보장기관은 제20조에 따른 생활보장위원회의 심의ㆍ의결을 거쳐 그 비용의 전부 또는 일부를 그 부양의무자로부터 부양의무의 범위에서 징수할 수 있다.

② 속임수나 그 밖의 부정한 방법으로 급여를 받거나 타인으로 하여금 급여를 받게 한 경우에는 보장비용을 지급한 보장기관은 그 비용의 전부 또는 일부를 그 급여를 받은 사람 또는 급여를 받게 한 자(이하 "부정수급자"라 한다)로부터 징수할 수 있다.

③ 제1항 또는 제2항에 따라 징수할 금액은 각각 부양의무자 또는 부정수급자에게 통지하여 징수하고, 부양의무자 또는 부정수급자가 이에 응하지 아니하는 경우 국세 또는 지방세 체납처분의 예에 따라 징수한다.
