국가통합교통체계효율화법 제74조(지방자치단체의 지능형교통체계계획 수립 등)

① 시ㆍ도지사 또는 시장ㆍ군수(광역시에 있는 군수는 제외한다. 이하 "시장등"이라 한다)는 지능형교통체계기본계획 및 분야별 계획을 반영하여 해당 지역의 지능형교통체계에 관한 기본계획(이하 "지능형교통체계지방계획"이라 한다)을 수립할 수 있다. 다만, 관할 지역에서 제77조에 따른 교통체계지능화사업을 하려는 경우에는 사업 시행 전에 지능형교통체계지방계획을 수립하여야 한다.

② 시ㆍ도지사 또는 시장등은 제1항에도 불구하고 지역 여건상 필요하다고 인정되는 경우에는 인접한 특별시ㆍ광역시ㆍ시 또는 군(광역시의 관할 구역에 있는 군은 제외한다)의 관할 구역의 전부 또는 일부를 포함하여 지능형교통체계지방계획을 수립할 수 있다. 이 경우 미리 해당 지방자치단체의 장과 협의하여야 한다.

③ 시ㆍ도지사 또는 시장등은 지능형교통체계지방계획을 수립하려면 관계 행정기관의 장, 관련 교통시설의 관리청, 관계 시ㆍ도지사 또는 시장등과 협의하여야 한다.

④ 시ㆍ도지사 또는 시장등은 지능형교통체계지방계획을 입안한 때에는 대통령령으로 정하는 바에 따라 시ㆍ도지사는 국토교통부장관 및 해양수산부장관(해양수산부장관은 해상교통 분야가 포함된 경우에만 해당한다. 이하 제5항에서 같다)에게 지능형교통체계지방계획안을 제출하여야 하며, 시장등은 국토교통부장관 및 해양수산부장관과 도지사에게 지능형교통체계지방계획안을 제출하여야 한다. <개정 2013.3.23>

⑤ 국토교통부장관ㆍ해양수산부장관 또는 도지사는 제4항에 따라 지능형교통체계지방계획안을 제출받으면 해당 지능형교통체계지방계획이 지능형교통체계기본계획 및 분야별 계획과 맞지 아니하거나 지능형교통체계지방계획 간의 연계성 및 통합성을 유지하기 위하여 필요하다고 판단되는 경우에는 시ㆍ도지사 또는 시장등에게 그 계획안을 조정할 것을 요청할 수 있다. <개정 2013.3.23>

⑥ 시ㆍ도지사 또는 시장등은 제5항에 따른 조정 요청을 받은 경우 특별한 사유가 없으면 이를 반영하여 지능형교통체계지방계획을 확정ㆍ고시하고, 그 내용을 14일 이상 일반인이 열람할 수 있게 하여야 한다.

⑦ 지능형교통체계지방계획의 변경에 관하여는 제3항부터 제6항까지의 규정을 준용한다.
