국가통합교통체계효율화법 제102조의2(교통신기술사용협약)

① 기술개발자는 「건설산업기본법」 제2조제7호에 따른 건설사업자 중 대통령령으로 정하는 요건을 갖춘 자와 해당 교통신기술의 사용협약(이하 "교통신기술사용협약"이라 한다)을 체결할 수 있다. 이 경우 기술개발자 또는 교통신기술사용협약을 체결한 자는 대통령령으로 정하는 서류를 갖추어 국토교통부장관에게 교통신기술사용협약에 관한 증명서의 발급을 신청할 수 있다.

② 국토교통부장관은 제1항 후단에 따른 신청을 받은 경우 교통신기술사용협약을 체결한 자가 같은 항 전단에 따른 요건을 갖추었는지 확인한 후에 교통신기술사용협약에 관한 증명서를 발급하여야 한다.

③ 교통신기술사용협약의 기간은 해당 교통신기술의 보호기간 이내로 한다.

④ 제1항 후단에 따라 교통신기술사용협약에 관한 증명서의 발급을 신청하는 자는 국토교통부령으로 정하는 바에 따라 수수료를 내야 한다.

⑤ 그 밖에 교통신기술사용협약에 관한 세부적인 사항은 대통령령으로 정하는 기준에 따라 국토교통부장관이 정하여 고시한다.
