관세법 시행령 제67조(잠정덤핑방지관세액 등의 정산)

①제69조제1항의 규정에 해당되는 경우로서 법 제53조제3항의 규정에 의하여 잠정조치가 적용된 기간중에 수입된 물품에 대하여 부과하는 덤핑방지관세액이 잠정덤핑방지관세액과 같거나 많은 때에는 그 잠정덤핑방지관세액을 덤핑방지관세액으로 하여 그 차액을 징수하지 아니하며, 적은 때에는 그 차액에 상당하는 잠정덤핑방지관세액을 환급하여야 한다.

②법 제53조제1항의 규정에 의하여 담보가 제공된 경우로서 제69조제1항의 규정에 해당되는 경우에는 당해 잠정조치가 적용된 기간중에 소급부과될 덤핑방지관세액이 제공된 담보금액과 같거나 많은 경우에는 그 담보금액을 덤핑방지관세액으로 하여 그 차액을 징수하지 않으며, 적은 경우에는 그 차액에 상당하는 담보를 해제해야 한다. <개정 2024.2.29>

③제68조제1항의 규정에 의한 약속이 제61조제5항의 규정에 의한 본조사의 결과에 따라 당해 물품에 대한 덤핑사실 및 그로 인한 실질적 피해등의 사실이 있는 것으로 판정된 후에 수락된 경우로서 조사된 최종덤핑률을 기초로 산정한 덤핑방지관세액이 잠정덤핑방지관세액 또는 제공된 담보금액과 같거나 많은 경우에는 그 차액을 징수하지 않으며, 적은 경우에는 그 차액을 환급하거나 차액에 상당하는 담보를 해제해야 한다. <개정 2024.2.29>
