Public Official Election Act, Article 61 (Establishment of Election Campaign Organizations)
①선거운동 및 그 밖의 선거에 관한 사무를 처리하기 위하여 정당 또는 후보자는 다음 각호에 따라 선거사무소와 선거연락소를, 예비후보자는 선거사무소를, 정당은 중앙당 및 시ㆍ도당의 사무소에 선거대책기구 각 1개씩을 설치할 수 있다. <개정 1995.4.1, 1995.5.10, 2000.2.16, 2004.3.12, 2005.8.4, 2014.1.17, 2026.3.19>
(1) To handle election campaigns and other election affairs, political parties or candidates may establish election campaign offices and election campaign liaison offices as follows, preliminary candidates may establish an election campaign office, and political parties may establish one election strategy organization each in the offices of the central party and the Si/Do parties:
1. 대통령선거정당 또는 후보자가 설치하되, 선거사무소 1개소와 시ㆍ도 및 구ㆍ시ㆍ군(하나의 구ㆍ시ㆍ군이 2 이상의 국회의원지역구로 되거나 하나의 구ㆍ시ㆍ군의 일부가 인접한 구ㆍ시ㆍ군의 일부와 결합하여 국회의원지역구로 된 경우에는 국회의원지역구를 말한다. 이하 제5호에서 같다)마다 선거연락소 1개소
1. Presidential election: established by the political party or candidate; one election campaign office, and one election campaign liaison office for each Si/Do and each Gu/Si/Gun (where one Gu/Si/Gun forms two or more National Assembly constituencies, or part of one Gu/Si/Gun is combined with part of an adjacent Gu/Si/Gun to form a National Assembly constituency, the National Assembly constituency; hereinafter the same shall apply in subparagraph 5);
2. 지역구국회의원선거후보자가 설치하되, 당해 국회의원지역구안에 선거사무소 1개소. 다만, 하나의 국회의원지역구가 2 이상의 구ㆍ시ㆍ군으로 된 경우에는 선거사무소를 두지 아니하는 구ㆍ시ㆍ군마다 선거연락소 1개소
2. Constituency National Assembly election: established by the candidate; one election campaign office within the relevant National Assembly constituency. However, where one National Assembly constituency consists of two or more Gu/Si/Gun, one election campaign liaison office for each Gu/Si/Gun in which no election campaign office is located;
3. 비례대표국회의원선거 및 비례대표지방의회의원선거정당이 설치하되, 선거사무소 1개소(비례대표시ㆍ도의원선거의 경우에는 비례대표시ㆍ도의원후보자명부를 제출한 시ㆍ도마다, 비례대표자치구ㆍ시ㆍ군의원선거의 경우에는 비례대표자치구ㆍ시ㆍ군의원후보자명부를 제출한 자치구ㆍ시ㆍ군마다 선거사무소 1개소)
3. Proportional representation National Assembly election and proportional representation local council election: established by the political party; one election campaign office (for a proportional representation Si/Do council election, one election campaign office for each Si/Do for which a list of candidates for proportional representation Si/Do council members has been submitted; for a proportional representation autonomous Gu/Si/Gun council election, one election campaign office for each autonomous Gu/Si/Gun for which a list of candidates for proportional representation autonomous Gu/Si/Gun council members has been submitted);
4. 지역구지방의회의원선거후보자가 설치하되, 당해 선거구안에 선거사무소 1개소
4. Constituency local council election: established by the candidate; one election campaign office within the relevant constituency;
5. 시ㆍ도지사선거후보자가 설치하되, 당해 시ㆍ도안에 선거사무소 1개소와 당해 시ㆍ도안의 구ㆍ시ㆍ군마다 선거연락소 1개소
5. Election of a Mayor/Do Governor: established by the candidate; one election campaign office within the relevant Si/Do, and one election campaign liaison office for each Gu/Si/Gun within the Si/Do;
6. 자치구ㆍ시ㆍ군의 장 선거후보자가 설치하되, 해당 자치구ㆍ시ㆍ군 안에 선거사무소 1개소. 다만, 자치구가 아닌 구가 설치된 시의 경우에는 선거사무소를 두지 아니하는 구마다 선거연락소 1개소를 둘 수 있으며, 하나의 구ㆍ시ㆍ군이 2 이상의 국회의원지역구로 되거나 하나의 구ㆍ시ㆍ군의 일부가 인접한 구ㆍ시ㆍ군의 일부와 결합하여 국회의원지역구로 된 경우에는 선거사무소를 두지 아니하는 국회의원지역구마다 선거연락소 1개소를 둘 수 있다.
6. Election of the head of an autonomous Gu/Si/Gun: established by the candidate; one election campaign office within the relevant autonomous Gu/Si/Gun. However, in a Si in which non-autonomous Gu are established, one election campaign liaison office may be established for each Gu in which no election campaign office is located, and where one Gu/Si/Gun forms two or more National Assembly constituencies, or part of one Gu/Si/Gun is combined with part of an adjacent Gu/Si/Gun to form a National Assembly constituency, one election campaign liaison office may be established for each National Assembly constituency in which no election campaign office is located.
②선거사무소 또는 선거연락소는 시ㆍ도 또는 구ㆍ시ㆍ군의 사무소 소재지가 다른 시ㆍ도 또는 구ㆍ시ㆍ군의 구역안에 있는 때에는 제1항의 규정에 불구하고 그 시ㆍ도 또는 구ㆍ시ㆍ군의 사무소 소재지를 관할하는 시ㆍ도 또는 구ㆍ시ㆍ군의 구역안에 설치할 수 있다.
(2) Notwithstanding paragraph (1), where the office of a Si/Do or Gu/Si/Gun is located within the area of another Si/Do or Gu/Si/Gun, an election campaign office or election campaign liaison office may be established within the area of the Si/Do or Gu/Si/Gun having jurisdiction over the location of that office.
③정당ㆍ정당추천후보자 또는 정당소속 예비후보자의 선거사무소와 선거연락소는 그에 대응하는 정당[제61조의2(정당선거사무소의 설치)의 규정에 의한 정당선거사무소를 포함한다]의 사무소가 있는 때에는 그 사무소에 둘 수 있다. <개정 2004.3.12>
(3) The election campaign offices and election campaign liaison offices of a political party, a party-recommended candidate or a preliminary candidate belonging to a political party may be located in the office of the corresponding political party [including a party election office under Article 61-2 (Establishment of Party Election Offices)], if such an office exists.
④예비후보자가 제49조(후보자등록 등)의 규정에 의하여 후보자등록을 마친 때에는 당해 예비후보자의 선거사무소는 후보자의 선거사무소로 본다. <신설 2004.3.12>
(4) When a preliminary candidate completes candidate registration under Article 49 (Registration, etc. of Candidates), the election campaign office of the preliminary candidate shall be deemed the election campaign office of the candidate.
⑤선거사무소와 선거연락소는 고정된 장소 또는 시설에 두어야 하며, 「식품위생법」에 의한 식품접객영업소 또는 「공중위생관리법」에 의한 공중위생영업소안에 둘 수 없다. <개정 2000.2.16, 2005.8.4>
(5) Election campaign offices and election campaign liaison offices shall be located in a fixed place or facility, and may not be located in a food service establishment under the Food Sanitation Act or a public health business establishment under the Public Health Control Act.
⑥ 선거사무소, 선거연락소 및 선거대책기구에는 중앙선거관리위원회규칙으로 정하는 바에 따라 선거운동을 위한 간판ㆍ현판 및 현수막, 제64조의 선거벽보, 제65조의 선거공보, 제66조의 선거공약서 및 후보자의 사진을 첩부할 수 있다. 다만, 예비후보자의 선거사무소에는 간판ㆍ현판 및 현수막에 한하여 설치ㆍ게시할 수 있다. <개정 2010.1.25, 2014.1.17>
(6) At election campaign offices, election campaign liaison offices and election strategy organizations, signboards, nameplates and banners for election campaigns, election posters under Article 64, election bulletins under Article 65, election pledge books under Article 66 and photographs of the candidate may be put up, as prescribed by the Rules of the National Election Commission. However, at the election campaign office of a preliminary candidate, only signboards, nameplates and banners may be installed and displayed.
⑦예비후보자가 그 신분을 상실한 때에는 제1항의 규정에 의하여 설치한 선거사무소를 폐쇄하여야 하며, 이를 폐쇄하지 아니한 경우 선거구선거관리위원회는 당해 예비후보자에게 즉시 선거사무소의 폐쇄를 명하여야 한다. <신설 2004.3.12>
(7) When a preliminary candidate loses that status, he or she shall close the election campaign office established under paragraph (1), and if he or she does not close it, the constituency election commission shall immediately order the preliminary candidate to close the election campaign office.
