공공주택 특별법 제48조의5(금융정보등의 제공)

① 국토교통부장관은 「금융실명거래 및 비밀보장에 관한 법률」 제4조제1항과 「신용정보의 이용 및 보호에 관한 법률」 제32조제1항에도 불구하고 공공주택의 공급을 신청하는 신청자등이 제48조의4제1항에 따라 제출한 동의서면을 전자적 형태로 바꾼 문서에 의하여 금융기관등(「금융실명거래 및 비밀보장에 관한 법률」 제2조제1호에 따른 금융회사등, 「신용정보의 이용 및 보호에 관한 법률」 제25조에 따른 신용정보집중기관을 말한다. 이하 같다)의 장에게 금융정보ㆍ신용정보 또는 보험정보(이하 "금융정보등"이라 한다)의 제공을 요청할 수 있다.

② 제1항에 따라 금융정보등의 제공을 요청받은 금융기관등의 장은 「금융실명거래 및 비밀보장에 관한 법률」 제4조제1항과 「신용정보의 이용 및 보호에 관한 법률」 제32조제1항 및 제3항에도 불구하고 명의인의 금융정보등을 제공하여야 한다.

③ 제2항에 따라 금융정보등을 제공한 금융기관등의 장은 금융정보등의 제공사실을 명의인에게 통보하여야 한다. 다만, 명의인의 동의가 있는 경우에는 「금융실명거래 및 비밀보장에 관한 법률」 제4조의2제1항과 「신용정보의 이용 및 보호에 관한 법률」 제35조에도 불구하고 통보하지 아니할 수 있다.

④ 제1항 및 제2항에 따른 금융정보등의 제공요청 및 제공은 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제2조제1항제1호에 따른 정보통신망을 이용하여야 한다. 다만, 정보통신망의 손상 등 불가피한 사유가 있는 경우에는 그러하지 아니하다.

⑤ 제1항 및 제2항에 따른 업무에 종사하거나 종사하였던 자는 업무를 수행하면서 취득한 금융정보등을 이 법에서 정한 목적 외의 다른 용도로 사용하거나 다른 사람 또는 기관에 제공하거나 누설하여서는 아니 된다.

⑥ 제1항ㆍ제2항 및 제4항에 따른 금융정보등의 제공요청 및 제공 등에 필요한 사항은 대통령령으로 정한다.
