건강기능식품에 관한 법률 시행규칙 제14조(영업자의 지위승계신고)

①법 제11조제3항에 따른 영업자의 지위승계신고를 하려는 자는 별지 제28호서식의 건강기능식품 영업자 지위승계 신고서(전자문서로 된 신고서를 포함한다)에 다음 각 호의 구분에 따른 서류(전자문서를 포함한다)를 첨부하여 허가 또는 신고관청에 제출해야 한다. <개정 2004.12.10, 2006.7.3, 2006.11.20, 2008.9.22, 2014.2.3, 2018.9.28, 2026.6.2>

② 제1항에 따른 신청을 받은 허가관청 또는 신고관청은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 다음 각 호의 구분에 따른 서류(양도인과 양수인이 허가관청 또는 신고관청에 함께 방문하여 신고하는 경우에는 제외한다)를 확인하여야 한다. 다만, 신고인이 확인에 동의하지 아니하는 경우에는 이를 첨부하도록 하여야 한다. <신설 2018.9.28>

③ 허가관청 또는 신고관청은 신고인이 법 제9조제1항제3호 또는 같은 조 제2항제3호에 해당하는지를 내부적으로 확인할 수 없는 경우에는 제1항에 따른 서류 외에 사실확인에 필요한 자료를 제출하게 할 수 있다. 이 경우 신고인이 외국인인 경우에는 해당 국가의 정부나 그 밖의 권한 있는 기관이 발행한 서류 또는 공증인이 공증한 신고인의 진술서로서 다음 각 호의 어느 하나에 해당하는 서류를 제출하게 할 수 있다. <개정 2026.6.2>

④제1항의 규정에 따라 영업자지위승계신고를 하는 자가 제4조제2항제2호 및 제6조제1항제2호의 규정에 의한 영업소의 명칭 또는 상호를 변경하고자 하는 경우에는 이를 함께 신고할 수 있다. <개정 2006.7.3>
