갯벌 및 그 주변지역의 지속가능한 관리와 복원에 관한 법률 제34조(손실보상)

① 제33조제1항에 따라 재산상의 손실을 입은 자는 대통령령으로 정하는 바에 따라 해양수산부장관 또는 관할 지방자치단체의 장에게 보상을 청구할 수 있다.

② 해양수산부장관 또는 지방자치단체의 장은 제1항에 따라 청구를 받은 때에는 3개월 이내에 청구인과 협의하여 보상할 금액 등을 결정하고 이를 청구인에게 통지하여야 한다.

③ 제1항에 따른 보상의 대상이 어업행위에 관한 것일 경우 보상의 기준, 지급방법, 그 밖에 보상에 필요한 사항은 「수산업법」 제88조를 따른다. <개정 2022.1.11>

④ 제2항에 따른 협의가 성립되지 아니한 때에는 해양수산부장관, 지방자치단체의 장 또는 청구인은 대통령령으로 정하는 바에 따라 토지의 경우 관할 토지수용위원회에 재결을 신청할 수 있다.
