1959년 12월 31일 이전에 퇴직한 군인의 퇴직급여금지급에 관한 특별법 시행령 제4조(퇴직급여금의 산정방법)

①법 제5조의 규정에 의한 퇴직급여금 산정은 별표 1의 계급(퇴직 또는 사망 당시의 계급을 말한다. 이하 같다)별 기준봉급액을 다음각 호의 방법에 의하여 산정한다.

②법 제5조의 규정에 의한 재직기간의 계산은 임명된 달부터 퇴직된 달 또는 사망한 달까지로 하되, 대한민국정부가 수립되기 전의 재직기간 및 사병으로 입대한 경우에는 별표 2의 현역병 복무연한은 산입하지 아니한다. 다만, 특진 등의 사유로 사병으로의 재직기간이 별표 2의 현역병 복무연한보다 짧은 경우에는 사병으로 실제 복무한 기간만을 재직기간에 산입하지 아니한다.

③제2항의 재직기간을 계산함에 있어 전투근무의 기간은 이를 3배로 계산하되, 그 기준은 별표 3에 의한다.

(3) In인 calculating캘큘레이팅 the^ð더 period피^r리어드 of어^v브 service서^v비스 under언더 paragraph패^r러그^r래^f프 (2), the^ð더 period피^r리어드 of어^v브 combat캄뱃 service서^v비스 shall섈 be비 counted카운티드 three^θ쓰^r리 times,타임즈 and앤드 the^ð더 criteria크^r라이티^r리아 therefor^ð데어^f포 shall섈 be비 as애즈 specified스페서^f파이드 in인 Annexed애넥스트 Table테이블 3.
