형사사법절차에서의 전자문서 이용 등에 관한 법률 제16조(전자문서의 열람ㆍ복사 등)

① 「형사소송법」 제35조, 제55조, 제59조의2, 제59조의3, 제174조, 제185조, 제200조의4, 제220조의2, 제245조의12, 제262조의2 단서, 제266조의3, 제266조의4, 제266조의11, 제294조의4 및 제294조의5에도 불구하고 이 법에 따라 작성된 전자문서를 열람ㆍ등사 또는 복사하는 경우에는 인터넷이나 전산정보처리시스템을 통하여 전자적으로 열람 또는 복사하거나 전송하는 방법으로 할 수 있다. <개정 2026.8.4>

② 제1항에도 불구하고 등록사용자가 아닌 자가 전자문서의 열람 또는 복사를 신청하는 경우에는 전자문서를 전산정보처리시스템을 통하여 출력한 서면을 교부하는 방법으로 할 수 있다.

③ 제1항에 따라 전자문서를 열람 또는 복사하거나 전송하는 절차와 방법은 대통령령 또는 대법원규칙으로 정한다. 이 경우 전자문서의 동일성 유지를 위한 기술적 조치에 관한 사항을 그 내용에 포함하여야 한다.

④ 피고인(피고인이었던 사람을 포함한다) 또는 변호인(변호인이었던 사람을 포함한다)은 제1항에 따라 열람 또는 복사하거나 전송받은 「형사소송법」 제266조의3제1항에 따른 서류(그 목록을 포함한다)에 해당하는 전자문서를 해당 사건 또는 관련 사건의 소송을 준비하기 위한 목적이 아닌 다른 목적으로 다른 사람에게 인터넷 또는 전산정보처리시스템을 통하여 전송하거나 교부(전자문서를 서면으로 출력하여 교부하는 것을 말한다) 또는 제시(전자문서를 서면으로 출력하여 제시하는 것과 전기통신설비를 통하여 제공하는 것을 포함한다)하여서는 아니 된다.
