Enforcement Decree of the Maritime Traffic Safety Act, Article 28 (Delegation of Authority)
① 해양수산부장관은 법 제109조제1항에 따라 다음 각 호의 권한을 지방해양수산청장에게 위임한다. 다만, 제6호부터 제10호까지, 제36호 및 제40호는 「배타적 경제수역 및 대륙붕에 관한 법률」 제2조에 따른 배타적 경제수역과 「항만법」 제3조제2항제1호 및 같은 조 제3항제1호에 따른 국가관리무역항 및 국가관리연안항의 항만구역에 대해서만 적용하고, 제33호ㆍ제34호 및 제38호는 어선(「원양산업발전법」 제6조제1항에 따른 원양어업허가를 받은 어선은 제외한다)이나 어선사업장에 대해서는 적용하지 않는다. <개정 2025.5.20>
(1) Pursuant to Article 109 (1) of the Act, the Minister of Oceans and Fisheries delegates the following authority to the head of a Regional Office of Oceans and Fisheries. However, subparagraphs 6 through 10, 36, and 40 apply only to the exclusive economic zone under Article 2 of the Act on the Exclusive Economic Zone and the Continental Shelf and the port areas of State-managed trading ports and State-managed coastal ports under Article 3 (2) 1 and (3) 1 of the Harbor Act, and subparagraphs 33, 34, and 38 do not apply to fishing vessels (excluding fishing vessels that have obtained deep-sea fishing permits under Article 6 (1) of the Deep-Sea Fisheries Development Act) or fishing vessel workplaces:

1. Consultation on fishery licenses, permits, etc., in specified sea areas for traffic safety under Article 9 (4) of the Act
2. 법 제10조제1항에 따른 공사 또는 작업의 허가, 같은 조 제2항에 따른 허가 사실의 보고, 같은 조 제3항에 따른 공사 또는 작업의 정지 명령 및 허가 취소
