Enforcement Decree of the Special Act on Fact-Finding Investigation and Relief for Damage of the Pohang Earthquake, Article 14 (Fact-Finding Investigations for Recognition of Victims, etc.)
① 심의위원회는 법 제16조제3항에 따라 피해자 인정 등을 결정하는 경우에는 피해현장 방문, 신청인 면담 등의 방법으로 필요한 사실조사를 실시해야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 제출 서류만으로 사실조사를 할 수 있다.
(1) When deciding on recognition of victims, etc. under Article 16 (3) of the Act, the Deliberation Committee shall conduct necessary fact-finding investigations by methods such as visiting the damaged site and interviewing the applicant. However, in any of the following cases, the fact-finding investigation may be conducted on the basis of submitted documents only:
1. 제출 서류만으로 피해사실 및 피해금액을 확인할 수 있는 경우
1. Where the facts and amount of damage can be verified from submitted documents alone;
2. 심의위원회가 정하는 일정 금액 이하에 해당하는 피해인 경우
2. Where the damage is below a certain amount determined by the Deliberation Committee;
3. 다음 각 목의 어느 하나에 해당하는 피해 복구비의 일부를 국가 또는 지방자치단체로부터 이미 지원받은 경우
3. Where part of the recovery costs for damage falling under either of the following has already been supported by the State or a local government:
가. 「공동주택관리법」 제85조제1항의 위임에 따른 포항시 조례에 따른 공동주택의 관리비용에 대한 지원금
(a) Support payments for multi-family housing management costs under an ordinance of Pohang City delegated pursuant to Article 85 (1) of the Multi-Family Housing Management Act;
나. 「재난 및 안전관리 기본법」 제66조제3항에 따른 「사립학교법」 제2조제1호에 따른 사립학교 중 유치원, 초등학교, 중학교 및 고등학교에 대한 복구사업비
(b) Recovery project costs for kindergartens, elementary schools, middle schools, and high schools among private schools under Article 2, subparagraph 1 of the Private School Act under Article 66 (3) of the Framework Act on the Management of Disasters and Safety.
② 심의위원회는 제1항에 따른 사실조사를 하는 경우 포항지진 당시 「자연재난 구호 및 복구 비용 부담기준 등에 관한 규정」 제9조제2항 및 제3항에 따라 신고된 자연재난 피해신고서, 포항시가 작성한 현장조사대장 등의 자료를 활용할 수 있다. <개정 2021.6.1>
(2) When conducting the fact-finding investigation under paragraph (1), the Deliberation Committee may use materials such as natural disaster damage reports filed under Article 9 (2) and (3) of the Regulations on the Standards for Bearing Costs of Relief and Recovery from Natural Disasters, etc. at the time of the Pohang Earthquake and the on-site investigation ledgers prepared by Pohang City.
