통합방위법 제12조(통합방위사태의 선포)

① 통합방위사태는 갑종사태, 을종사태 또는 병종사태로 구분하여 선포한다.

② 제1항의 사태에 해당하는 상황이 발생하면 다음 각 호의 구분에 따라 해당하는 사람은 즉시 국무총리를 거쳐 대통령에게 통합방위사태의 선포를 건의하여야 한다. <개정 2013.3.22, 2013.3.23, 2014.11.19, 2017.7.26>

③ 대통령은 제2항에 따른 건의를 받았을 때에는 중앙협의회와 국무회의의 심의를 거쳐 통합방위사태를 선포할 수 있다.

④ 시ㆍ도경찰청장, 지역군사령관 또는 함대사령관은 을종사태나 병종사태에 해당하는 상황이 발생한 때에는 즉시 시ㆍ도지사에게 통합방위사태의 선포를 건의하여야 한다. <개정 2013.3.22, 2020.12.22>

⑤ 시ㆍ도지사는 제4항에 따른 건의를 받은 때에는 시ㆍ도 협의회의 심의를 거쳐 을종사태 또는 병종사태를 선포할 수 있다.

⑥ 시ㆍ도지사는 제5항에 따라 을종사태 또는 병종사태를 선포한 때에는 지체 없이 행정안전부장관 및 국방부장관과 국무총리를 거쳐 대통령에게 그 사실을 보고하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>

⑦ 제3항이나 제5항에 따라 통합방위사태를 선포할 때에는 그 이유, 종류, 선포 일시, 구역 및 작전지휘관에 관한 사항을 공고하여야 한다.

⑧ 시ㆍ도지사가 통합방위사태를 선포한 지역에 대하여 대통령이 통합방위사태를 선포한 때에는 그 때부터 시ㆍ도지사가 선포한 통합방위사태는 효력을 상실한다.

⑨ 제1항부터 제8항까지에서 규정한 사항 외에 통합방위사태의 구체적인 선포 요건ㆍ절차 및 공고 방법 등에 관하여 필요한 사항은 대통령령으로 정한다.
