통상조약의 체결절차 및 이행에 관한 법률 제4조(정보의 공개)

① 정부는 통상조약 체결절차 및 이행에 관한 정보의 공개 청구가 있는 경우 「공공기관의 정보공개에 관한 법률」에 따라 관련 정보를 청구인에게 공개하여야 하며, 통상협상의 진행을 이유로 공개를 거부하여서는 아니 된다.

② 제1항에도 불구하고 통상협상에 관한 정보가 다음 각 호의 어느 하나에 해당되는 경우에는 공개하지 아니할 수 있다. 다만, 국회 교섭단체 간의 합의를 거쳐 국회의장의 요구가 있는 경우에는 정부는 공개를 거부할 수 없다.

③ 정부는 제2항에 따라 통상협상에 관한 정보를 공개하지 아니하기로 결정한 경우에는 그 사실을 청구인에게 지체 없이 문서로 통지하여야 한다. 이 경우 비공개 이유ㆍ불복방법 및 불복절차를 구체적으로 명시하여야 한다.
