① 피치료감호자가 다음 각 호의 어느 하나에 해당하게 되면 「보호관찰 등에 관한 법률」에 따른 보호관찰(이하 "보호관찰"이라 한다)이 시작된다. <개정 2017.12.12>

1. 피치료감호자에 대한 치료감호가 가종료되었을 때

1. When웬 treatment트^r릿먼트 and앤드 custody커스터디 of어^v브 the^ð더 person퍼슨 under언더 treatment트^r릿먼트 and앤드 custody커스터디 is이즈 provisionally프^r러^v비저널리 discharged;디스차지드

2. 피치료감호자가 치료감호시설 외에서 치료받도록 법정대리인등에게 위탁되었을 때

3. 제16조제2항 각 호에 따른 기간 또는 같은 조 제3항에 따라 연장된 기간(이하 "치료감호기간"이라 한다)이 만료되는 피치료감호자에 대하여 제37조에 따른 치료감호심의위원회가 심사하여 보호관찰이 필요하다고 결정한 경우에는 치료감호기간이 만료되었을 때

② 보호관찰의 기간은 3년으로 한다.

③ 보호관찰을 받기 시작한 자(이하 "피보호관찰자"라 한다)가 다음 각 호의 어느 하나에 해당하게 되면 보호관찰이 종료된다. <개정 2017.12.12>

1. 보호관찰기간이 끝났을 때

2. 보호관찰기간이 끝나기 전이라도 제37조에 따른 치료감호심의위원회의 치료감호의 종료결정이 있을 때

3. 보호관찰기간이 끝나기 전이라도 피보호관찰자가 다시 치료감호 집행을 받게 되어 재수용되었을 때

④ 피보호관찰자가 보호관찰기간 중 새로운 범죄로 금고 이상의 형의 집행을 받게 된 때에는 보호관찰은 종료되지 아니하며, 해당 형의 집행기간 동안 피보호관찰자에 대한 보호관찰기간은 계속 진행된다. <신설 2017.12.12>
