축산물 위생관리법 제26조(영업의 승계)

① 영업자가 사망하거나 그 영업을 양도하거나 법인인 영업자가 합병하였을 때에는 그 상속인이나 영업 양수인이나 합병 후 존속하는 법인 또는 합병으로 설립되는 법인(이하 "양수인등"이라 한다)은 그 영업자의 지위를 승계한다.

(1) Where웨어 a어 business비즈니스 operator아퍼^r레이터 dies다이즈 or오 transfers트^r랜스^f퍼즈 the^ð더 business,비즈니스 or오 where웨어 a어 business비즈니스 operator아퍼^r레이터 that^ð댓 is이즈 a어 corporation코퍼^r레이션 merges,머지즈 the^ð디 heir,에어 the^ð더 transferee트^r랜스^f퍼^r리 of어^v브 the^ð더 business,비즈니스 or오 the^ð더 corporation코퍼^r레이션 surviving서^v바이^v빙 the^ð더 merger머저 or오 established이스태블리시트 as애즈 a어 result^r리절트 of어^v브 the^ð더 merger머저 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "transferee,트^r랜스^f퍼^r리 etc.")엣세터^r러 shall섈 succeed석시드 to투 the^ð더 status스태터스 of어^v브 the^ð더 business비즈니스 operator.아퍼^r레이터

② 다음 각 호의 어느 하나에 해당하는 절차에 따라 영업용 시설의 전부를 인수한 자는 그 영업자의 지위를 승계한다.

(2) A어 person퍼슨 who후 has해즈 taken테이큰 over오우^v버 all올 business비즈니스 facilities^f퍼실러티즈 through^θ쓰^r루 any에니 of어^v브 the^ð더 following^f팔로잉 procedures프^r러시저즈 shall섈 succeed석시드 to투 the^ð더 status스태터스 of어^v브 the^ð더 business비즈니스 operator:아퍼^r레이터

③ 제1항 또는 제2항에 따라 그 영업자의 지위를 승계한 자는 총리령으로 정하는 바에 따라 승계한 날부터 30일 이내에 그 사실을 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장에게 신고하여야 한다. <개정 2013.3.23, 2017.10.24>

(3) A어 person퍼슨 who후 has해즈 succeeded석시디드 to투 the^ð더 status스태터스 of어^v브 the^ð더 business비즈니스 operator아퍼^r레이터 under언더 paragraph패^r러그^r래^f프 (1) or오 (2) shall섈 report^r리포트 the^ð더 fact^f팩트 to투 a어 Mayor/Do메이어 Governor거^v버너 or오 a어 Mayor/Gun메이어 head/Gu헤드 head헤드 within위^ð딘 30 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 succession,석세션 as애즈 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Prime프^r라임 Minister.미너스터

④ 제1항 및 제2항에 따른 승계에 관하여는 제22조제3항 및 제24조제3항을 준용한다.
