초지법 시행규칙 제15조의6(대체초지조성비의 환급 등)

①시장ㆍ군수ㆍ구청장은 납부의무자가 대체초지조성비로 납부한 금액 중 영 제16조의2제7항 각 호에 따라 환급해야 할 금액이 있는 때에는 지체 없이 그 금액을 대체초지조성비환급금으로 결정하고 이를 대체초지조성비의 납부자 및 기금관리자에게 각각 알려야 한다. <개정 2015.7.21, 2020.6.11, 2023.12.21>

②시장ㆍ군수ㆍ구청장은 제1항에 따라 대체초지조성비환급금을 통보하는 때에는 다음 각 호의 어느 하나에 해당하는 날의 다음날부터 환급결정을 하는 날까지의 기간에 「국세기본법 시행령」 제43조의3제2항에 따른 국세환급가산금의 이율로 계산한 금액을 환급가산금으로 결정하고, 이를 대체초지조성비의 환급금과 함께 알려야 한다. <개정 2007.3.28, 2015.7.21, 2020.6.11>

③영 제16조의2제7항제2호 또는 제3호에 따라 대체초지조성비의 환급을 받으려는 자는 해당 초지의 훼손된 부분을 전용허가 당시의 상태로 원상복구한 후 시장ㆍ군수ㆍ구청장의 확인을 받아야 한다. <개정 2015.7.21, 2020.6.11, 2023.12.21>

⑤제4항에 따른 환급 요청 시 담당 공무원은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통해 주민등록표 등본(법인의 경우에는 법인등기사항증명서)을 확인해야 한다. 다만, 요청인이 주민등록표 등본의 확인에 동의하지 않는 경우에는 이를 첨부하도록 해야 한다. <신설 2006.6.30, 2020.6.11, 2022.1.20>

⑥제4항에 따른 환급요청을 받은 기금관리자는 지체 없이 해당 대체초지조성비환급금 및 환급가산금을 지급한 후 별지 제14호의8서식의 대장에 그 내용을 정리하고, 환급내역을 관할 시장ㆍ군수ㆍ구청장에게 통지하여야 한다. <개정 2006.6.30, 2015.7.21>
