초ㆍ중등교육법 시행령 제26조(읍ㆍ면ㆍ동의 장 및 교육장의 취학 독촉ㆍ경고 및 보고)

① 읍ㆍ면ㆍ동의 장 및 교육장(중학교의 경우에는 교육장만을 말한다. 이하 이 조에서 같다)은 제25조제4항 각 호 외의 부분에 따라 같은 항 제1호의 사항을 통보받은 경우에는 지체 없이 해당 아동이나 학생의 보호자 또는 고용자에게 해당 아동이나 학생의 취학 또는 출석을 독촉하거나 의무교육을 받는 것을 방해하지 아니하도록 경고하여야 한다.

② 읍ㆍ면ㆍ동의 장 및 교육장은 제1항에 따른 독촉을 위하여 필요한 경우 해당 아동이나 학생의 가정을 방문할 수 있다.

③ 읍ㆍ면ㆍ동의 장 및 교육장은 제2항에 따라 가정을 방문하는 경우에는 해당 아동이나 학생이 취학할 예정이거나 취학 중인 학교의 장에게 동행을 요청할 수 있으며, 필요하면 해당 아동이나 학생의 거주지를 관할하는 경찰서의 장에게 협조를 요청할 수 있다. 이 경우 요청을 받은 학교의 장 또는 경찰서의 장은 특별한 사유가 없으면 적극 협조하여야 한다. <개정 2018.10.2>

④ 교육장은 제1항에 따른 독촉 또는 경고를 2회 이상 하여도 그 상태가 계속되는 경우에는 그 경과를 교육감에게 지체 없이 보고하여야 한다.
