철도의 건설 및 철도시설 유지관리에 관한 법률 제15조(대체공공시설등의 설치)

① 국토교통부장관은 철도건설사업에 편입되는 부지에 대통령령으로 정하는 공공시설, 군사시설 또는 공용건축물(철도시설은 제외하며, 이하 이 조에서 "공공시설등"이라 한다)이 있는 경우에는 그 공공시설등의 관리청 또는 소유자의 신청을 받아 사업시행자로 하여금 기존의 공공시설등을 대체하는 공공시설등(이하 이 조에서 "대체공공시설등"이라 한다)을 설치하게 할 수 있다. <개정 2013.3.23>

② 국토교통부장관은 제1항에 따라 사업시행자로 하여금 대체공공시설등을 설치하게 하는 경우에는 대통령령으로 정하는 바에 따라 실시계획을 승인할 때에 그 사실을 분명히 밝혀야 한다. <개정 2013.3.23>

③ 제16조에 따라 대체공공시설등에 대한 준공확인을 받은 경우에는 「국유재산법」ㆍ「공유재산 및 물품 관리법」 또는 그 밖의 다른 법령에도 불구하고 다음 각 호의 구분에 따라 처리된다.

④ 제3항에 따른 대체공공시설등을 등기할 때에는 실시계획 인가서 또는 그 변경 인가서와 준공확인서로 「부동산등기법」에 따른 등기원인을 증명하는 서류를 갈음한다.
