채무자 회생 및 파산에 관한 법률 시행령 제16조(면제재산)

① 법 제383조제2항제1호에 따라 파산재단에서 면제할 수 있는 임차보증금반환청구권의 상한액은 「주택임대차보호법 시행령」 제10조제1항에서 정한 금액으로 하되, 그 금액이 주택가격의 2분의 1을 초과하는 경우에는 주택가격의 2분의 1로 한다. <개정 2013.12.30>

② 법 제383조제2항제2호에서 "대통령령이 정하는 금액"이란 「국민기초생활 보장법」 제2조제11호에 따른 4인가구 기준 중위소득(파산선고 당시의 기준 중위소득을 말한다)의 100분의 40에 6을 곱한 금액을 말한다. <개정 2019.3.5, 2024.6.11>
