질서위반행위규제법 제41조(재판비용)

① 과태료 재판절차의 비용은 과태료에 처하는 선고가 있는 경우에는 그 선고를 받은 자의 부담으로 하고, 그 외의 경우에는 국고의 부담으로 한다.

② 항고법원이 당사자의 신청을 인정하는 과태료 재판을 한 때에는 항고절차의 비용과 전심에서 당사자의 부담이 된 비용은 국고의 부담으로 한다.
