지역상권 상생 및 활성화에 관한 법률 제12조(지역상생구역의 신청 및 지정)

① 제14조에 따른 지역상생협의체를 대표하는 자는 예비지역상생구역 내 상인, 상가건물 임대인 및 토지소유자(이하 "예비지역상생구역내상인등"이라 한다) 각각의 3분의 2 이상에 해당하는 자의 동의를 받은 경우 시장ㆍ군수ㆍ구청장에게 지역상생구역의 지정을 신청할 수 있다.

② 지역상생협의체를 대표하는 자는 지역상생구역이 지정된 후 변경이 필요한 경우 예비지역상생구역내상인등 각각의 3분의 2 이상의 동의를 받아 구역의 변경을 신청할 수 있다.

③ 시장ㆍ군수ㆍ구청장은 지역상생구역의 지정 또는 변경 신청을 받은 때에는 다음 각 호의 요건을 검토하여 시ㆍ도지사에게 승인을 신청하여야 한다. 다만, 대통령령으로 정하는 경미한 사항을 변경하려는 경우에는 그러하지 아니하다.

④ 예비지역상생구역내상인등은 제1항 및 제2항에 따른 지역상생구역 지정 신청ㆍ변경에 대한 동의를 시장ㆍ군수ㆍ구청장이 시ㆍ도지사에게 승인을 신청하기 전까지 철회할 수 있다.

⑤ 시장ㆍ군수ㆍ구청장은 제3항에 따른 승인 신청을 하려는 때에는 대통령령으로 정하는 바에 따라 공청회를 거쳐 주민과 관계 전문가 등의 의견을 수렴하여야 한다.

⑥ 시ㆍ도지사는 제3항에 따른 승인 신청을 받은 경우 지역상권위원회의 심의를 거쳐 30일 이내에 승인 여부를 결정하고, 이를 시장ㆍ군수ㆍ구청장에게 통보하여야 한다. 다만, 정당한 사유가 있으면 지역상권위원회의 의결로 한 차례만 15일의 범위에서 심의기간을 연장할 수 있다.

⑦ 시ㆍ도지사가 제6항에서 정한 기간 내에 승인 여부를 통지하지 아니하면 그 기간이 끝난 날(제6항 단서에 따라 심의기간이 연장된 경우에는 해당 심의기간을 말한다)의 다음 날에 승인을 한 것으로 본다.

⑧ 시장ㆍ군수ㆍ구청장은 제6항에 따라 시ㆍ도지사의 승인을 받았을 때에는 지역상생구역으로 지정하거나 변경하여야 한다. 이 경우 중소벤처기업부장관에게 그 사실을 보고하고 관보나 공보에 공고하여야 한다.

⑨ 그 밖에 동의자 수의 산정방법 등 지역상생구역의 지정, 신청 및 신청철회에 필요한 사항은 대통령령으로 정한다.
