지방재정법 시행령 제39조(의무지출의 범위)
Enforcement Decree of the Local Finance Act, Article 39 (Scope of Mandatory Expenditure)
법 제33조제3항제6호에 따른 의무지출의 범위는 다음 각 호와 같다. <개정 2015.10.6, 2017.3.27>
The scope of mandatory expenditure under Article 33 (3) 6 of the Act is as follows:
1. 「지방교육재정교부금법」 제11조제2항에 따른 교육비특별회계전출금, 「지방세징수법」 제17조에 따른 징수교부금, 법 제29조 및 제29조의2에 따른 조정교부금
1. Transfers to the special account for education expenses under Article 11 (2) of the Local Education Finance Grant Act, collection grants under Article 17 of the Local Tax Collection Act, and adjustment grants under Articles 29 and 29-2 of the Act;
2. 국고보조사업 또는 법 제23조제2항에 따라 시ㆍ도가 시ㆍ군 및 자치구에 보조금을 교부하는 사업에 소요되는 경비(국고보조금 및 법 제23조제2항에 따라 시ㆍ도가 시ㆍ군 및 자치구에 교부하는 보조금을 포함한다)
2. Expenses required for national treasury subsidy projects or projects in which a Si/Do grants subsidies to Sis, Guns, and autonomous Gus under Article 23 (2) of the Act (including national treasury subsidies and subsidies that a Si/Do grants to Sis, Guns, and autonomous Gus under Article 23 (2) of the Act);
3. 지방채 및 차입금 등에 대한 이자지출
3. Interest expenditure on local bonds and borrowings, etc.;
4. 「유아교육법」 제24조와 같은 법 시행령 제29조 및 제34조제3항ㆍ제5항에 따른 공통의 교육ㆍ보육과정 지원비
4. Support expenses for common education and childcare curricula under Article 24 of the Early Childhood Education Act and Articles 29 and 34 (3) and (5) of the Enforcement Decree of that Act;
5. 그 밖에 법령에 따라 지출과 지출규모가 결정되는 경비
