Enforcement Decree of the Act on Contracts to Which a Local Government Is a Party, Article 4 (Contracts by International Bidding)
① 법 제5조제1항제4호에 따라 국제입찰에 의하여 계약을 체결할 수 없는 경우는 다음 각 호와 같다. <개정 2014.2.5, 2022.9.20>
(1) The cases in which a contract cannot be concluded by international bidding under Article 5 (1) 4 of the Act are as follows:
1. 공공의 질서 및 안정을 유지하거나 인간이나 동식물의 생명과 건강 및 지적소유권을 보호하기 위하여 필요한 경우
1. Where necessary to maintain public order and stability or to protect the life and health of humans, animals, and plants and intellectual property rights;
2. 자선단체, 장애인 및 재소자가 생산한 물품과 용역 등을 조달하는 경우
2. Where goods and services, etc. produced by charitable organizations, persons with disabilities, and inmates are procured;
3. 재판매 또는 판매할 목적이나, 재판매 또는 판매를 위한 물품 및 용역의 공급에 사용할 목적으로 물품 및 용역을 조달하는 경우
3. Where goods and services are procured for the purpose of resale or sale, or for the purpose of use in the supply of goods and services for resale or sale;
4. 급식프로그램을 증진하기 위하여 조달하는 경우
4. Where procured to promote school meal programs;
5. 자치경찰사무의 수행을 위해 무기 또는 탄약을 조달하는 경우
5. Where weapons or ammunition are procured for the performance of municipal police affairs.
② 법 제5조제3항에 따라 국제입찰에 의하여 계약을 체결할 수 있는 경우는 다음 각 호와 같다.
(2) The cases in which a contract may be concluded by international bidding under Article 5 (3) of the Act are as follows:
1. 부실공사를 방지하기 위하여 필요하다고 인정되는 경우
1. Where recognized as necessary to prevent defective construction;
2. 국내생산이 곤란하여 국내입찰로는 조달목적을 달성할 수 없는 경우
2. Where domestic production is difficult and the purpose of procurement cannot be achieved by domestic bidding;
3. 그 밖에 국제입찰에 의하여 조달하는 것이 해당 계약의 목적ㆍ성질상 효율적이라고 인정되는 경우
3. Other cases where procurement by international bidding is recognized as efficient in light of the purpose and nature of the contract.
