Enforcement Decree of the Restriction of Special Local Taxation Act, Article 40 (Scope of One Household Owning One House)

법 제81조제3항 각 호 외의 부분에서 "대통령령으로 정하는 1가구 1주택"이란 취득일 현재 취득자와 같은 세대별 주민등록표에 기재되어 있는 가족(동거인은 제외한다)으로 구성된 1가구(취득자의 배우자와 취득자의 미혼인 30세 미만의 직계비속은 각각 취득자와 같은 세대별 주민등록표에 기재되어 있지 아니하더라도 같은 가구에 속한 것으로 본다)가 다음 각 호의 구분에 따른 지역에서 해당 기관에 대한 「신행정수도 후속대책을 위한 연기ㆍ공주지역 행정중심복합도시 건설을 위한 특별법」 제16조제5항에 따른 이전계획의 고시일이나 「혁신도시 조성 및 발전에 관한 특별법」 제4조제4항에 따른 지방이전계획의 승인일 또는 업무개시일(법 제81조제3항제1호다목의 경우에만 해당한다) 이후 1개의 주택을 최초로 취득하는 것을 말한다. 이 경우 주택의 부속토지만을 소유하는 경우에도 주택을 소유한 것으로 본다. <개정 2013.1.1, 2016.12.30, 2018.2.27>
