지방공기업법 제82조(벌칙)

① 회계감사인, 회계감사인에 소속된 공인회계사, 감사(제78조의4에 따른 평가원의 감사는 제외한다) 또는 회계감사인선임위원회의 위원이 그 직무에 관하여 부정한 청탁을 받고 그 대가로서 금품이나 이익을 받거나 요구한 경우 또는 받기로 약속한 경우에는 3년 이하의 징역 또는 3천만원 이하의 벌금에 처한다. 다만, 벌금형에 처하는 경우 그 직무와 관련하여 얻은 경제적 이익의 5배에 해당하는 금액이 3천만원을 초과하면 그 직무와 관련하여 얻은 경제적 이익의 5배에 상당하는 금액 이하의 벌금에 처한다.

② 제1항에 따른 금품이나 이익을 약속 또는 제공하거나 제공의 의사를 표시한 자도 제1항과 같다.

③ 제1항과 제2항에 따른 금품이나 이익은 몰수한다. 다만, 그 전부 또는 일부를 몰수할 수 없으면 그 가액(價額)을 추징한다.
