Local Public Enterprises Act, Article 58 (Appointment and Dismissal of Officers)

① 공사의 임원은 사장을 포함한 이사(상임이사와 비상임이사로 구분한다) 및 감사로 하며, 그 수는 정관으로 정한다.

② 사장과 감사는 대통령령으로 정하는 바에 따라 지방공기업의 경영에 관한 전문적인 식견과 능력이 있는 사람 중에서 지방자치단체의 장이 임면(任免)한다. 다만, 제50조제1항에 따라 설립된 공사의 경우에는 지방자치단체 간의 규약으로 정하는 바에 따른다.

③ 지방자치단체의 장은 제2항에 따라 사장과 감사(조례 또는 정관으로 정하는 바에 따라 당연히 감사로 선임되는 사람은 제외한다)를 임명할 경우 대통령령으로 정하는 임원추천위원회(이하 이 조에서 "임원추천위원회"라 한다)가 추천한 사람 중에서 임명하여야 한다. 다만, 「지방자치법」 제47조의2에 따라 인사청문회를 실시하는 경우에는 임원추천위원회의 추천 절차를 생략할 수 있다. <개정 2023.3.21>

④ 지방자치단체의 장은 사장의 경영성과에 따라 임기 중에 해임하거나 임기가 끝나더라도 임원추천위원회의 심의를 거쳐 연임시킬 수 있다. 이 경우 다음 각 호의 사항을 고려하여야 한다. <개정 2013.6.4, 2023.3.21>

⑥ 제4항에 따른 사장의 연임 또는 해임의 기준 등에 관하여 필요한 사항은 대통령령으로 정한다. <개정 2015.12.15>
