중소기업협동조합법 제52조(임원의 임기)

①임원의 임기는 비상근의 경우 4년으로 하고, 상근의 경우 3년으로 한다. 다만, 설립 당시의 임원의 임기는 1년으로 한다.

② 임원은 연임할 수 있다. 다만, 이사장은 두 차례만 연임할 수 있다. <신설 2018.3.13>

③결원으로 인하여 선출된 임원의 임기는 전임자의 임기 종료일까지로 하고, 임원의 증원으로 임기 동안에 따로 선출된 임원의 임기는 선출 당시 다른 임원의 임기 종료일까지로 한다. 다만, 상근 이사의 경우에는 3년으로 한다. <개정 2018.3.13>

④임원 중 결원이 있으면 결원의 사유가 발생한 날부터 2개월 이내에 결원된 임원을 선출하여야 한다. 다만, 남은 임기가 6개월 미만이면 이사회의 의결을 거쳐 결원된 임원을 선출하지 아니할 수 있다. <개정 2018.3.13>

⑤임원 전원이 임기 중에 사임하면 새로 선출된 임원의 임기는 제1항 본문에 따른 임기로 한다. 다만, 그 임기 만료 연도의 정기총회의 종료일까지로 한다. <개정 2018.3.13>
