주택법 제28조(간선시설의 설치 및 비용의 상환)

① 사업주체가 대통령령으로 정하는 호수 이상의 주택건설사업을 시행하는 경우 또는 대통령령으로 정하는 면적 이상의 대지조성사업을 시행하는 경우 다음 각 호에 해당하는 자는 각각 해당 간선시설을 설치하여야 한다. 다만, 제1호에 해당하는 시설로서 사업주체가 제15조제1항 또는 제3항에 따른 주택건설사업계획 또는 대지조성사업계획에 포함하여 설치하려는 경우에는 그러하지 아니하다.

② 제1항 각 호에 따른 간선시설은 특별한 사유가 없으면 제49조제1항에 따른 사용검사일까지 설치를 완료하여야 한다.

③ 제1항에 따른 간선시설의 설치 비용은 설치의무자가 부담한다. 이 경우 제1항제1호에 따른 간선시설의 설치 비용은 그 비용의 50퍼센트의 범위에서 국가가 보조할 수 있다.

④ 제3항에도 불구하고 제1항의 전기간선시설을 지중선로(地中線路)로 설치하는 경우에는 전기를 공급하는 자와 지중에 설치할 것을 요청하는 자가 각각 50퍼센트의 비율로 그 설치 비용을 부담한다. 다만, 사업지구 밖의 기간시설로부터 그 사업지구 안의 가장 가까운 주택단지(사업지구 안에 1개의 주택단지가 있는 경우에는 그 주택단지를 말한다)의 경계선까지 전기간선시설을 설치하는 경우에는 전기를 공급하는 자가 부담한다.

⑤ 지방자치단체는 사업주체가 자신의 부담으로 제1항제1호에 해당하지 아니하는 도로 또는 상하수도시설(해당 주택건설사업 또는 대지조성사업과 직접적으로 관련이 있는 경우로 한정한다)의 설치를 요청할 경우에는 이에 따를 수 있다.

⑥ 제1항에 따른 간선시설의 종류별 설치 범위는 대통령령으로 정한다.

⑦ 간선시설 설치의무자가 제2항의 기간까지 간선시설의 설치를 완료하지 못할 특별한 사유가 있는 경우에는 사업주체가 그 간선시설을 자기부담으로 설치하고 간선시설 설치의무자에게 그 비용의 상환을 요구할 수 있으며, 간선시설 설치의무자는 이에 따라야 한다. <개정 2026.2.3>

⑧ 제7항에 따른 간선시설 설치 비용의 상환 방법 및 절차 등에 필요한 사항은 대통령령으로 정한다.
