주택법 시행령 제95조(고유식별정보의 처리)
Enforcement Decree of the Housing Act, Article 95 (Processing of Personally Identifiable Information)
국토교통부장관(제90조 및 제91조에 따라 국토교통부장관의 권한을 위임받거나 업무를 위탁받은 자를 포함한다), 시ㆍ도지사, 시장, 군수, 구청장(해당 권한이 위임ㆍ위탁된 경우에는 그 권한을 위임ㆍ위탁받은 자를 포함한다), 사업주체(법 제11조의2제1항에 따른 주택조합 업무대행자, 주택 청약접수 및 입주자 선정 업무를 위탁받은 자를 포함한다) 또는 한국토지주택공사는 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호, 제2호 또는 제4호에 따른 주민등록번호, 여권번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2017.6.2, 2018.3.13, 2020.7.24, 2021.2.19, 2021.7.6, 2021.9.7, 2024.6.18>
Where unavoidable to perform the following affairs, the Minister of Land, Infrastructure and Transport (including persons to whom the Minister's authority has been delegated or work entrusted under Articles 90 and 91), a Mayor/Do Governor, a Si Mayor, a Gun Governor, a Gu head (including, where the relevant authority has been delegated or entrusted, the person to whom it has been delegated or entrusted), a project proponent (including an agent for housing association business under Article 11-2 (1) of the Act, and a person entrusted with receiving housing subscriptions and selecting occupants), or the Korea Land and Housing Corporation may process materials containing resident registration numbers, passport numbers, or alien registration numbers under Article 19, subparagraph 1, 2, or 4 of the Enforcement Decree of the Personal Information Protection Act:
1. 법 제4조제1항에 따른 주택건설사업 또는 대지조성사업의 등록에 관한 사무
1. Affairs concerning the registration of housing construction businesses or building-site development businesses under Article 4 (1) of the Act;
2. 법 제6조에 따른 등록사업자의 결격사유 확인에 관한 사무
2. Affairs concerning verification of the grounds for disqualification of registered business operators under Article 6 of the Act;
3. 법 제13조제1항에 따른 주택조합의 발기인 또는 임원의 결격사유 확인에 관한 사무
3. Affairs concerning verification of the grounds for disqualification of the promoters or officers of housing associations under Article 13 (1) of the Act;
4. 법 제49조에 따른 사용검사 또는 임시 사용승인에 관한 사무
4. Affairs concerning use inspections or temporary use approvals under Article 49 of the Act;
5. 법 제54조 및 제57조의2제7항에 따른 주택 공급에 관한 사무
5. Affairs concerning the supply of housing under Articles 54 and 57-2 (7) of the Act;
5의2. 법 제57조의2제2항 및 제3항에 따른 주택의 매입에 관한 사무
5-2. Affairs concerning the purchase of housing under Article 57-2 (2) and (3) of the Act;
5의3. 법 제57조의2제6항에 따른 부기등기 말소를 위한 거주사실 확인에 관한 사무
5-3. Affairs concerning confirmation of actual residence for cancellation of additional registrations under Article 57-2 (6) of the Act;
5의4. 법 제57조의3에 따른 분양가상한제 적용주택의 거주실태 조사에 관한 사무
5-4. Affairs concerning surveys of actual residence in housing subject to the sale price ceiling under Article 57-3 of the Act;
5의5. 법 제65조제2항에 따른 이미 체결된 주택 공급계약의 취소에 관한 사무
5-5. Affairs concerning cancellation of housing supply contracts already concluded under Article 65 (2) of the Act;
6. 법 제65조제5항에 따른 입주자자격 제한에 관한 사무
6. Affairs concerning restrictions on occupant qualifications under Article 65 (5) of the Act;
6의2. 법 제65조제6항에 따른 매수인의 공급질서교란행위 관련 여부 소명에 관한 사무
6-2. Affairs concerning a buyer's showing as to whether he or she is connected with an act disrupting the order of supply under Article 65 (6) of the Act;
6의3. 법 제78조의2제1항 및 제2항에 따른 토지임대부 분양주택의 공공매입에 관한 사무
6-3. Affairs concerning the public purchase of land-lease sale housing under Article 78-2 (1) and (2) of the Act;
7. 제21조제1항에 따른 조합원의 자격 확인에 관한 사무
7. Affairs concerning verification of the qualifications of association members under Article 21 (1);
7의2. 제73조제5항에 따른 전매 동의에 관한 사무
