Special Act on Fostering Traditional Markets and Shopping Districts, Article 65 (Merchants' Associations)

① 시장등에서 사업을 직접 경영하는 상인의 전부 또는 일부는 상인회를 자율적으로 설립할 수 있다. <개정 2013.5.28>

② 상인회를 법인으로 설립하려는 경우 상인회는 주된 사무소의 소재지에서 설립등기를 함으로써 성립한다. <개정 2021.4.20>

③ 상인회를 설립하려는 자는 중소벤처기업부령으로 정하는 바에 따라 시장ㆍ군수ㆍ구청장에게 등록하여야 한다. 이 경우 법인인 상인회는 정관을 작성하여 시장ㆍ군수ㆍ구청장의 인가를 받아야 한다. 정관을 변경할 때에도 같다. <개정 2013.3.23, 2017.7.26>

1. 시설 및 경영의 현대화를 위한 사업

1. Projects프^r라젝츠 for^f포 modernizing마더나이징 facilities^f퍼실러티즈 and앤드 management;매너지먼트

2. 상인의 매출 증대 및 영업활성화를 위한 공동사업

2. Joint조인트 projects프^r라젝츠 for^f포 increasing인크^r리싱 sales세일즈 and앤드 revitalizing^r리^v바이털라이징 business비즈니스 of어^v브 merchants;머천츠

3. 상인 교육 및 지역주민과의 협력사업

3. Merchant머천트 education에저케이션 and앤드 cooperation코아퍼^r레이션 projects프^r라젝츠 with위^ð드 local로우클 residents;^r레지던츠

4. 상거래 질서유지 및 고객불만 처리에 관한 업무

⑤ 상인회는 상인회의 운영 및 제4항 각 호의 사업 수행에 필요한 경비를 회원으로부터 징수할 수 있다.

⑥ 중소벤처기업부장관 및 시장ㆍ군수ㆍ구청장은 필요한 경우 상인회의 운영에 관한 서류의 제출을 요구할 수 있다. <개정 2017.7.26>

(6) The^ð더 Minister미너스터 of어^v브 SMEs스메즈 and앤드 Startups스타텁스 and앤드 the^ð더 Mayor/Gun메이어 head/Gu헤드 head헤드 may메이 require^r리콰이어 the^ð더 submission서브미션 of어^v브 documents다큐먼츠 concerning컨서닝 the^ð디 operation아퍼^r레이션 of어^v브 a어 merchants'머천츠 association어소우시에이션 where웨어 necessary.네서세^r리

⑦ 정부와 지방자치단체는 상인회가 제4항 각 호에 따른 사업을 수행할 때 필요한 비용을 예산의 범위에서 지원할 수 있다.

⑧ 시장ㆍ군수ㆍ구청장은 제3항에 따라 등록된 상인회가 다음 각 호의 어느 하나에 해당하는 경우에는 그 등록을 취소할 수 있다. 다만, 제1호에 해당하는 경우에는 등록을 취소하여야 한다. <신설 2019.1.8, 2021.4.20>

1. 거짓이나 그 밖의 부정한 방법으로 등록받은 경우

4. 등록된 상인회와 동일한 시장등의 상인 2분의 1 이상, 토지소유자 총수 및 건축물 소유자 총수 각 2분의 1 이상의 동의로 등록 취소를 요청하는 경우

⑩ 제8항 및 제9항에 따른 상인회의 등록 취소 절차에 관하여 필요한 사항은 시ㆍ군ㆍ구의 조례로 정한다. <신설 2019.1.8>
