Special Act on Fostering Traditional Markets and Shopping Districts, Article 14 (Opening of Temporary Markets)

① 시장ㆍ군수ㆍ구청장은 「유통산업발전법」 제14조에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우 일정 기간 시장의 기능을 하는 시장(이하 "임시시장"이라 한다)을 개설할 수 있다. 다만, 임시시장의 면적이 대통령령으로 정하는 규모 이상인 경우에는 임시시장을 개설하려는 자(시장ㆍ군수ㆍ구청장은 제외한다)는 시장ㆍ군수ㆍ구청장에게 신고하여야 한다. <개정 2012.12.11>

② 시장ㆍ군수ㆍ구청장은 제1항에 따른 신고를 받은 날부터 5일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2018.6.12>

③ 시장ㆍ군수ㆍ구청장이 제2항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2018.6.12>

④ 시장ㆍ군수ㆍ구청장은 임시시장의 개설을 위하여 필요하면 국유지나 공유지의 사용을 정부와 시ㆍ도지사에게 요청하거나 소관 공유재산, 공공장소 및 교통에 지장을 주지 아니하는 장소 등을 일시적으로 사용하게 하는 등 임시시장 개설과 관리에 필요한 지원을 할 수 있다. <개정 2018.6.12>
