재해경감을 위한 기업의 자율활동 지원에 관한 법률 시행령 제16조(출연금의 지급ㆍ관리 등)

① 주관연구개발기관은 법 제24조제2항에 따라 연구개발사업에 필요한 비용 중 정부 외의 자의 출연금이나 그 밖의 기업 연구개발비가 포함되어 있는 경우에는 그 비용을 부담하는 자와 미리 출연 등에 관한 계약을 체결해야 한다. <개정 2025.2.18>

② 법 제24조제3항에 따른 정부의 출연금은 연구개발사업의 추진정도를 고려하여 분할하여 지급한다. 다만, 연구개발사업의 규모ㆍ착수시기 등을 고려하여 필요하다고 인정할 때에는 한꺼번에 지급할 수 있다.

③ 주관연구개발기관은 법 제24조제2항에 따라 기업의 연구개발사업에 필요한 비용을 받았을 때에는 별도의 계정을 설정하여 관리해야 한다. <개정 2025.2.18>

④ 제2항에 따라 출연금을 지급받은 주관연구개발기관은 그 출연금을 「국가연구개발혁신법 시행령」 별표 2에 따른 연구개발비 사용용도로만 사용해야 하며, 「국가연구개발혁신법」 제13조제4항에 따른 연구개발비 사용 기준에 따라 사용해야 한다. <개정 2025.2.18>

⑤ 행정안전부장관은 주관연구개발기관이 정당한 사유 없이 제4항에 따른 용도와 기준을 위반하여 제2항에 따라 지급받은 출연금을 사용한 경우에는 해당 금액을 환수해야 한다. <개정 2025.2.18>
