재외동포의 출입국과 법적 지위에 관한 법률 시행령 제11조(국내거소 이전신고 등)

①거소를 이전한 사람이 법 제6조제2항에 따라 국내거소 이전신고를 하려는 경우에는 국내거소 이전신고서에 법무부령으로 정하는 서류를 첨부하여 신거소(新居所)를 관할하는 시ㆍ군ㆍ구의 장, 읍ㆍ면ㆍ동의 장 또는 청장ㆍ사무소장ㆍ출장소장에게 제출하여야 한다. 이 경우 국내거소 이전신고는 법무부장관이 정하는 정보통신망을 이용하여 할 수 있다. <개정 2007.10.15, 2016.9.29, 2018.5.8, 2018.6.12, 2020.2.18, 2023.12.12>

② 제1항에 따라 국내거소 이전신고를 받은 시ㆍ군ㆍ구의 장, 읍ㆍ면ㆍ동의 장 또는 청장ㆍ사무소장ㆍ출장소장은 국내거소신고증에 거소이전 사항을 기재하여 신고인에게 교부하여야 한다. <개정 2007.10.15, 2016.9.29, 2018.5.8, 2023.12.12>

③ 제1항에 따라 국내거소 이전신고를 받은 시ㆍ군ㆍ구의 장 또는 읍ㆍ면ㆍ동의 장은 전거소(前居所)를 관할하는 시ㆍ군ㆍ구의 장 또는 읍ㆍ면ㆍ동의 장에게 국내거소 이전신고서 사본을 송부하고 해당 외국국적동포의 국내거소신고표를 이송해 줄 것을 요청해야 하며, 국내거소 이전신고를 받은 청장ㆍ사무소장ㆍ출장소장은 전거소를 관할하는 청장ㆍ사무소장ㆍ출장소장에게 국내거소 이전신고서 사본을 송부하고 국내거소신고 원부를 이송해 줄 것을 요청해야 한다. <개정 2023.12.12>

④ 법 제6조제3항에 따라 국내거소 이전신고 사실을 통보받은 시ㆍ군ㆍ구의 장 또는 읍ㆍ면ㆍ동의 장은 전거소를 관할하는 시ㆍ군ㆍ구의 장 또는 읍ㆍ면ㆍ동의 장에게 해당 외국국적동포의 국내거소신고표를, 청장ㆍ사무소장ㆍ출장소장은 전거소를 관할하는 청장ㆍ사무소장ㆍ출장소장에게 국내거소신고 원부를 각각 이송하여 줄 것을 요청하여야 한다. <신설 2007.10.15, 2014.10.28, 2016.9.29, 2018.5.8, 2023.12.12>

⑤ 제3항 또는 제4항에 따라 기록의 이송을 요청받은 전거소를 관할하는 시ㆍ군ㆍ구의 장, 읍ㆍ면ㆍ동의 장 또는 청장ㆍ사무소장ㆍ출장소장은 국내거소신고표 또는 국내거소신고 원부에 관련 서류를 첨부하여 요청을 받은 날부터 3일 이내에 이를 신거소를 관할하는 시ㆍ군ㆍ구의 장, 읍ㆍ면ㆍ동의 장 또는 청장ㆍ사무소장ㆍ출장소장에게 이송하여야 한다. <신설 2007.10.15, 2016.9.29, 2018.5.8, 2018.6.12>

⑥ 제5항에 따라 국내거소신고 원부와 관련 서류를 이송받은 신거소를 관할하는 청장ㆍ사무소장ㆍ출장소장은 국내거소신고 원부를, 국내거소신고표와 관련 서류를 이송받은 신거소를 관할하는 시ㆍ군ㆍ구의 장 또는 읍ㆍ면ㆍ동의 장은 국내거소신고표와 국내거소신고인명부를 각각 정리하고 관리하여야 한다. <개정 2018.6.12>
