장기등 이식에 관한 법률 제17조(뇌사추정자의 신고 및 뇌사판정의 신청)

① 뇌사로 추정되는 사람(이하 "뇌사추정자"라 한다)을 진료한 의료기관의 장은 제20조에 따른 장기구득기관의 장에게 알려야 하고, 통보를 받은 장기구득기관의 장은 국립장기이식관리기관의 장에게 그 사실을 신고하여야 한다.

② 뇌사추정자의 장기등을 기증하기 위하여 뇌사판정을 받으려는 사람은 보건복지부령으로 정하는 바에 따라 뇌사추정자의 검사기록 및 진료담당의사의 소견서를 첨부하여 뇌사판정기관의 장에게 뇌사판정 신청을 하여야 한다.

③ 제2항에 따라 뇌사판정을 신청할 수 있는 사람은 다음 각 호의 어느 하나에 해당하는 사람으로 한다.

④ 제1항에 따라 통보하여야 하는 뇌사추정자의 기준 및 장기구득기관의 장이 국립장기이식관리기관의 장에게 신고하는 데 필요한 절차 및 방법 등은 보건복지부령으로 정한다.
