장기등 이식에 관한 법률 제12조(장기등의 기증에 관한 동의)

Act on Organ and Other Transplants, Article 12 (Consent to Donation of Organs, etc.)

① 이 법에 따른 장기등기증자ㆍ장기등기증희망자 본인 및 가족ㆍ유족의 장기등의 기증에 관한 동의는 다음 각 호에 따른 것이어야 한다.

② 제22조제3항제1호 단서에 따른 뇌사자 또는 사망한 자의 장기등의 적출에 관한 그 가족 또는 유족의 거부의 의사표시는 제4조제6호 각 목에 따른 가족 또는 유족의 순위에 따른 선순위자 1명이 하여야 한다.

③ 제1항제2호 및 제2항에 따른 선순위자 1명을 확정할 때 선순위자에 포함되는 사람이 2명 이상이면 그중 촌수ㆍ연장자순(촌수가 우선한다)에 따른 1명으로 한다.
