Act on Organ and Other Transplants, Article 11 (Prohibition of Removal and Transplantation of Organs, etc.)

① 다음 각 호의 어느 하나에 해당하는 장기등은 이를 적출하거나 이식하여서는 아니 된다.

(1) Organs,오근즈 etc.엣세터^r러 falling^f팔링 under언더 any에니 of어^v브 the^ð더 following^f팔로잉 shall섈 not낫 be비 removed^r리무^v브드 or오 transplanted:트^r랜스플랜티드

1. 장기등을 이식하기에 적합하지 아니한 감염성병원체에 감염된 장기등

1. Organs,오근즈 etc.엣세터^r러 infected인^f펙티드 with위^ð드 infectious인^f펙셔스 pathogens패^θ써전즈 unsuitable언수터블 for^f포 transplantation;트^r랜즈플랜테이션

2. 암세포가 침범한 장기등

3. 그 밖에 이식대상자의 생명ㆍ신체에 위해를 가할 우려가 있는 것으로서 대통령령으로 정하는 장기등

② 이식대상자가 정하여지지 아니한 경우에는 장기등을 적출하여서는 아니 된다. 다만, 안구 등 상당한 기간이 지난 후에도 이식이 가능한 장기등으로서 대통령령으로 정하는 장기등의 경우에는 그러하지 아니하다.

③ 살아있는 사람으로서 다음 각 호의 어느 하나에 해당하는 사람의 장기등은 적출하여서는 아니 된다. 다만, 제1호에 해당하는 사람의 경우에는 말초혈과 골수에 한정하여 적출할 수 있다. <개정 2011.8.4, 2020.4.7>

1. 16세 미만인 사람

2. 임신한 여성 또는 해산한 날부터 3개월이 지나지 아니한 사람

④ 살아있는 사람으로서 16세 이상인 미성년자의 장기등(말초혈과 골수는 제외한다)은 배우자ㆍ직계존비속ㆍ형제자매 또는 4촌 이내의 친족에게 이식하는 경우가 아니면 적출할 수 없다. <개정 2020.4.7>

1. 신장은 정상인 것 2개 중 1개

2. 간장ㆍ말초혈ㆍ골수ㆍ폐 및 대통령령으로 정하는 장기등은 의학적으로 인정되는 범위에서 그 일부
