자연유산의 보존 및 활용에 관한 법률 제20조(천연기념물 수출 등의 금지)

① 천연기념물은 국외로 수출하거나 반출할 수 없다.

② 제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우에는 그 반출한 날부터 2년 이내에 다시 반입할 것을 조건으로 국가유산청장의 허가를 받아 천연기념물을 반출할 수 있다. <개정 2024.2.13>

③ 제2항에 따라 천연기념물의 반출 허가를 받은 자가 그 반출 기간을 연장하려는 경우에는 허가기간 만료일 5개월 전까지 문화체육관광부령으로 정하는 바에 따라 국가유산청장에게 기간 연장을 신청하여야 한다. <개정 2024.2.13>

④ 국가유산청장은 제3항에 따른 신청을 받은 경우에는 반출목적 달성이나 천연기념물의 안전 등 문화체육관광부령으로 정하는 바에 따라 필요하다고 인정하는 경우 2년의 범위에서 그 반출 기간의 연장을 허가할 수 있다. <개정 2024.2.13>

⑤ 국가유산청장은 제2항에 따라 국외 반출을 허가받은 자에게 해당 천연기념물의 현황 및 보존ㆍ관리 실태 등의 자료를 제출하도록 요구할 수 있다. 이 경우 요구를 받은 자는 특별한 사유가 없으면 이에 따라야 한다. <개정 2024.2.13>

⑥ 제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우에는 국가유산청장의 허가를 받아 수출할 수 있다. <개정 2024.2.13>

⑦ 국가유산청장은 제6항에 따른 허가의 신청을 받은 날부터 30일 이내에 허가 여부를 신청인에게 통지하여야 한다. <개정 2024.2.13>

⑧ 국가유산청장이 제7항에서 정한 기간 내에 허가 또는 변경허가 여부나 민원 처리 관련 법령에 따른 처리기간의 연장을 신청인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 허가 또는 변경허가를 한 것으로 본다. <개정 2024.2.13>

⑨ 그 밖에 천연기념물의 반출ㆍ수출 허가 및 연장허가의 절차와 방법 등에 관하여 필요한 사항은 문화체육관광부령으로 정한다.
