자동차 등 특정동산 저당법 제7조(저당권의 행사 등)

① 저당권자는 제6조에 따른 통지를 받으면 그 특정동산에 대하여 즉시 그 권리를 행사할 수 있다.

③ 등록관청은 제2항에 따른 저당권행사의 개시 기한까지 저당권의 행사 절차가 개시되지 아니한 경우에는 특정동산에 대하여 말소의 등록을 할 수 있다. 다만, 저당권자가 그 기간 내에 저당권의 행사 절차를 개시한 경우에는 그 행사 절차가 완료될 때까지 말소등록을 하여서는 아니 된다.

④ 등록관청은 저당권자가 저당권을 행사하여 경매의 매수인이 그 특정동산에 대한 소유권을 취득한 경우에는 특정동산에 대하여 말소등록을 하여서는 아니 된다.

(4) Where웨어 the^ð더 mortgagee모기지 has해즈 exercised엑서사이즈드 the^ð더 mortgage모거지 and앤드 the^ð더 purchaser퍼처서 at앳 the^ð디 auction악션 has해즈 acquired어콰이어드 ownership오우너쉽 of어^v브 the^ð더 specified스페서^f파이드 movables,무^v버블즈 the^ð더 registration^r레지스트^r레이션 authority어^θ쏘^r러티 shall섈 not낫 register^r레지스터 the^ð더 cancellation캔설레이션 of어^v브 the^ð더 specified스페서^f파이드 movables.무^v버블즈

⑤ 매각허가결정이 확정된 경우에는, 건설기계에 관하여는 「건설기계관리법」 제6조제1항에 따른 등록말소신청이 없었던 것으로 보며, 항공기 또는 경량항공기에 관하여는 「항공안전법」 제15조제1항제3호(같은 법 제121조제1항에서 준용하는 경우를 포함한다)의 사유가 발생하지 아니한 것으로 본다. <개정 2015.5.18, 2016.3.29>
