이러닝(전자학습)산업 발전 및 이러닝 활용 촉진에 관한 법률 제20조의5(중소이러닝사업자에 대한 지원)

① 정부는 중소이러닝사업자의 육성을 통한 이러닝산업의 건전한 발전을 위하여 공공기관이 발주하는 이러닝콘텐츠 제작, 시스템 구축 및 이와 관련된 연구개발사업(이하 이 조에서 "이러닝개발사업"이라 한다)에 중소이러닝사업자의 참여를 확대할 수 있는 조치를 마련하여야 한다.

② 산업통상부장관은 공공기관이 발주하는 이러닝개발사업에 중소이러닝사업자의 참여를 확대하기 위하여 필요하다고 인정하는 때에는 이러닝개발사업의 성격을 고려하여 대기업인 이러닝사업자가 참여할 수 있는 사업금액의 하한을 정하여 이를 고시하고 공공기관의 장에게 그 적용을 요청할 수 있다. <개정 2013.3.23, 2025.10.1>

③ 제1항 및 제2항에 따른 이러닝개발사업의 종류 및 대기업인 이러닝사업자의 기준은 대통령령으로 정한다.
