음악산업진흥에 관한 법률 제29조(영업소폐쇄 및 음반등의 수거ㆍ폐기)

①시장ㆍ군수ㆍ구청장은 제16조 및 제18조의 규정에 따른 신고 또는 등록을 하지 아니하고 영업을 하는 자와 제27조제1항의 규정에 따른 영업의 폐쇄명령 또는 등록의 취소처분을 받고 계속하여 영업을 하는 자에 대하여는 관계공무원으로 하여금 그 영업소를 폐쇄하기 위하여 다음 각 호의 조치를 하게 할 수 있다. <개정 2008.2.29, 2019.12.3, 2020.2.18>

②제1항의 조치를 하는 경우 미리 해당 영업자 또는 그 대리인에게 서면으로 이를 알려 주어야 한다. 다만, 대통령령으로 정하는 급박한 사유가 있는 경우에는 그러하지 아니하다. <개정 2019.12.3, 2023.8.8>

③시장ㆍ군수ㆍ구청장은 제16조의 규정에 따른 신고를 하지 아니한 자가 영리목적으로 제작한 음반등을 발견한 때에는 관계 공무원 등으로 하여금 이를 수거하여 삭제 또는 폐기하게 할 수 있다. <개정 2008.2.29, 2020.2.18>

④제3항의 규정에 따라 관계 공무원 등이 해당 음반등을 수거한 때에는 그 소유자 또는 점유자에게 수거증을 교부하여야 한다. 다만, 수거증의 인수를 거부한 경우에는 그러하지 아니하다. <개정 2019.12.3>

⑤시장ㆍ군수ㆍ구청장은 제3항의 규정에 따라 관계 공무원 등이 수거ㆍ폐기 등을 하는 경우 필요한 때에는 관련 협회 또는 단체에 협조를 요청할 수 있다. <개정 2008.2.29, 2020.2.18, 2023.8.8>

⑥제1항 및 제3항의 규정에 따라 게시물의 부착ㆍ봉인ㆍ수거ㆍ폐기 등의 처분을 하는 관계 공무원이나 협회 또는 단체의 임ㆍ직원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 내보여야 한다.
