Distribution Industry Development Act, Article 12 (Duties of Large-Scale Store, etc. Operators)

① 대규모점포등개설자는 다음 각 호의 업무를 수행한다.

(1) A어 large-scale라지-스케일 store,스토 etc.엣세터^r러 operator아퍼^r레이터 shall섈 perform퍼^f폼 the^ð더 following^f팔로잉 duties:두티즈

1. 상거래질서의 확립

2. 소비자의 안전유지와 소비자 및 인근 지역주민의 피해ㆍ불만의 신속한 처리

2. Maintaining메인테이닝 consumer컨수머 safety세이^f프티 and앤드 promptly프^r람프틀리 handling핸들링 damage대머지 and앤드 complaints컴플레인츠 of어^v브 consumers컨수머즈 and앤드 neighboring네이버^r링 residents;^r레지던츠 and앤드

3. 그 밖에 대규모점포등을 유지ㆍ관리하기 위하여 필요한 업무

② 매장이 분양된 대규모점포 및 등록 준대규모점포에서는 다음 각 호의 어느 하나에 해당하는 자(이하 "대규모점포등관리자"라 한다)가 제1항 각 호의 업무를 수행한다. <개정 2017.10.31>

1. 매장면적의 2분의 1 이상을 직영하는 자가 있는 경우에는 그 직영하는 자

가. 해당 대규모점포 또는 등록 준대규모점포에 입점(入店)하여 영업을 하는 상인(이하 "입점상인"이라 한다) 3분의 2 이상이 동의(동의를 얻은 입점상인이 운영하는 매장면적의 합은 전체 매장면적의 2분의 1 이상이어야 한다. 이하 이 장에서 같다)하여 설립한 「민법」 또는 「상법」에 따른 법인

나. 입점상인 3분의 2 이상이 동의하여 설립한 「중소기업협동조합법」 제3조제1항제1호에 따른 협동조합(이하 "협동조합"이라 한다) 또는 같은 항 제2호에 따른 사업협동조합(이하 "사업조합"이라 한다)

다. 입점상인 3분의 2 이상이 동의하여 조직한 자치관리단체. 이 경우 6개월 이내에 가목 또는 나목에 따른 법인ㆍ협동조합 또는 사업조합의 자격을 갖추어야 한다.

라. 가목부터 다목까지의 어느 하나에 해당하는 자가 없는 경우에는 입점상인 2분의 1 이상이 동의하여 지정하는 자. 이 경우 6개월 이내에 가목 또는 나목에 따른 법인ㆍ협동조합 또는 사업조합을 설립하여야 한다.

③ 대규모점포등관리자는 산업통상부령으로 정하는 바에 따라 특별자치시장ㆍ시장ㆍ군수ㆍ구청장에게 신고를 하여야 한다. 신고한 사항을 변경하려는 경우에도 또한 같다. <개정 2013.3.23, 2017.10.31, 2025.10.1>

④ 매장이 분양된 대규모점포 및 등록 준대규모점포에서는 제1항 각 호의 업무 중 구분소유(區分所有)와 관련된 사항에 대하여는 「집합건물의 소유 및 관리에 관한 법률」에 따른다.

⑤ 제2항에 따른 입점상인의 동의자 수 산정방법과 그 밖에 필요한 사항은 대통령령으로 정한다. <신설 2017.10.31>
